These Terms constitute a legally binding agreement between you and AI Response Generator ("we," "us," or "our"), operated from Vancouver, British Columbia, Canada.

2. Service Description

AI Response Generator provides AI-powered services to help users generate:

• Discussion and social media replies

Our services utilize third-party AI models, primarily from OpenAI and Google Gemini, to generate content based on user inputs.

Service Availability: Our service is provided "as is" and "as available" without any warranties. We do not guarantee uninterrupted or error-free service.

3. Eligibility and Account Registration

3.1 Age Requirement

You must be at least 13 years old to use our service. By using our service, you represent and warrant that you meet this age requirement.

3.2 Account Requirements

To create an account, you must:

• Provide a valid, verified email address
• Maintain one account per person (account sharing is prohibited)
• Provide accurate and truthful information
• Keep your account secure

3.3 Account Sharing Prohibition

Each account is for individual use only. Sharing your account credentials with others is strictly prohibited and may result in immediate account termination.

4. Subscription and Payment

4.1 Pricing Model

Our service operates on a subscription-based model with the following features:

• Subscription Plans: Available as monthly or annual subscriptions
• Credits System: Daily usage is limited by credits that vary by subscription tier
• Pricing Tiers: Different subscription levels offer different daily credit limits (see our Pricing page for details)

4.2 Credits System

Daily Credits:

• Reset daily at 00:00 UTC
• Amount varies based on your subscription tier
• Valid only during active subscription period
• Do not roll over to the next day

Bonus Credits:

• Valid for lifetime, even after subscription cancellation
• Can be used once daily credits are exhausted
• Never expire

Credit Consumption: Different AI models consume different amounts of credits per request.

4.3 Payment Processing

All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis according to your chosen billing cycle (monthly or annual).

4.4 Refund Policy

We offer a 7-day refund policy under the following conditions:

• Refund requests must be made within 7 days of subscription purchase
• No credits have been used
• No service features have been accessed

No refunds will be provided if:

• More than 7 days have passed since subscription purchase
• Any credits have been used or service features accessed

4.5 Subscription Cancellation

You may cancel your subscription at any time:

• Service will continue through the end of your current billing period
• Daily credits will remain available until the subscription period ends
• Bonus credits will remain available indefinitely
• No refunds for partial billing periods
• Automatic renewal will stop at the next billing cycle

4.6 Price Changes

We reserve the right to change our pricing. Price changes will not affect existing subscriptions until the next renewal cycle. We will notify you at least 30 days before any price increase.

5. Acceptable Use Policy

You agree NOT to use our service for:

5.1 Illegal Activities

• Any illegal purpose or to violate any laws
• Fraud, scams, or deceptive practices
• Harassment, abuse, or threats

5.2 Prohibited Content

• Generating spam or unsolicited communications
• Creating hate speech, violent, or discriminatory content
• Producing content that infringes on intellectual property rights
• Generating misleading or false information with intent to harm

5.3 Service Abuse

• Attempting to reverse engineer, decompile, or disassemble our service
• Circumventing usage limits or credit systems
• Automated scraping or bulk requests that impact service performance
• Reselling or redistributing our service without permission

5.4 Consequences of Violation

We reserve the right to immediately suspend or terminate your account if you violate these acceptable use policies, without refund or prior notice.

6. Intellectual Property and Content Ownership

6.1 Your Input Content

You retain all ownership rights to the content you input into our service (prompts, emails, discussion topics, etc.). You grant us a limited license to process this content solely for the purpose of providing our service.

6.2 AI-Generated Output

Regarding AI-generated content:

• To the extent permitted by law, you own the AI-generated output content
• AI-generated content may not meet copyright law requirements for "originality"
• Third-party AI providers (OpenAI, Google Gemini) may have specific terms regarding generated content
• You must comply with upstream AI service provider usage policies
• We do not claim ownership of AI-generated content
• We do not use your content for training or improving our service

Important: While we do not save your generated content, it is processed by third-party AI providers (OpenAI, Google Gemini) who may have their own data retention policies.

6.3 Our Service and Platform

All rights, title, and interest in and to our service, platform, website, branding, and technology remain our exclusive property.

7. Disclaimers and Limitations of Liability

7.1 AI Content Accuracy

WE MAKE NO WARRANTIES OR GUARANTEES regarding the accuracy, reliability, completeness, or appropriateness of AI-generated content. You acknowledge that:

• AI-generated content may contain errors, inaccuracies, or inappropriate suggestions
• You are solely responsible for reviewing, editing, and verifying all AI-generated content before use
• We are not responsible for any consequences arising from your use of AI-generated content
• AI models may produce inconsistent or unpredictable results

7.2 User Responsibility

YOU ARE SOLELY RESPONSIBLE for:

• Reviewing and verifying all AI-generated content before using it
• Ensuring generated content is appropriate for your intended use
• Any consequences resulting from your failure to review AI-generated content
• Compliance with applicable laws and regulations when using our service

7.3 Service Availability

We do not guarantee that our service will be:

• Available at all times without interruption
• Error-free or secure
• Compatible with all devices or systems

7.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are NOT liable for any damages resulting from your use or inability to use our service
• We are NOT liable for any losses caused by AI-generated content errors or inaccuracies
• We are NOT liable for losses resulting from your failure to review AI-generated content
• Our total liability shall not exceed the amount you paid for your subscription in the current billing period

7.5 Service Interruption Compensation

In the event of service interruption caused by our systems:

• We may provide credit compensation at our discretion
• Maximum compensation will not exceed your monthly subscription fee
• This does not apply to interruptions caused by third-party services, force majeure, or scheduled maintenance

8. Account Termination

8.1 Termination by You

• All your account information will be deleted
• Active subscriptions will be cancelled (no refunds for partial periods)
• This action is irreversible

8.2 Termination by Us

We reserve the right to suspend or terminate your account immediately, without prior notice, if you:

• Violate these Terms of Service
• Violate our Acceptable Use Policy
• Engage in fraudulent or illegal activities
• Abuse our service or systems

Termination for violations will result in forfeiture of any remaining credits or subscription time without refund.

9. Third-Party Services

Our service relies on third-party AI providers:

• OpenAI: GPT models for content generation
• Google Gemini: AI models for content generation

You acknowledge that:

• Your content may be processed by these third-party services
• These services have their own terms and privacy policies
• We are not responsible for third-party service interruptions or failures
• Service availability depends on third-party provider availability

10. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including but not limited to:

• War, terrorism, or civil unrest
• Natural disasters
• Major incidents or outages at upstream AI service providers
• Internet or telecommunications failures
• Government actions or regulations

11. Indemnification

You agree to indemnify, defend, and hold harmless AI Response Generator, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of our service
• Your violation of these Terms
• Your violation of any third-party rights
• Your failure to review AI-generated content before use
• Any content you input or generate using our service

12. Governing Law and Dispute Resolution

12.1 Applicable Law

These Terms shall be governed by and construed in accordance with:

• The laws of British Columbia, Canada
• The laws of California, United States (as applicable to upstream AI providers)

12.2 Dispute Resolution

In the event of any dispute arising from these Terms:

• If informal resolution fails, disputes may be resolved through binding arbitration
• Arbitration shall be conducted in English

13. Changes to Terms
